Terms of service

These terms are an agreement between you and [registered company name] (“Carinderya”), [registered address], Philippines. By creating an account or using the apps you accept them. Our privacy notice explains how we handle personal data.

1. What Carinderya is

Carinderya is a platform that lets customers order food from independent carinderias and have it delivered by the carinderia itself or by an independent Carinderya rider. Each carinderia prepares and sells its own food and is responsible for its quality, safety and permits.

2. Accounts

• You must be 18 or older [confirm] and give accurate information.
• Keep your password secret. You are responsible for activity on your account.
• We may suspend accounts that break these terms, are used for fraud, or put others at risk.

3. Orders, prices and fees (customers)

• Menu prices are set by each carinderia. The app shows the full total before you order.
• Delivery fee: ₱40 covers the first 2 km; after that ₱10 per km, counted per started half-kilometer. ₱20 is added while it rains in your area and ₱15 at night (8 PM–6 AM). The rider keeps the whole delivery fee.
• A ₱10 service fee is added to each order. This is how Carinderya is paid; carinderias pay no commission on your order.
• Vouchers and deals follow the conditions shown with them and may end at any time.
• Payment is cash on delivery unless the app offers another method. Please have the exact total ready.

4. Cancellations and problems

• You can cancel for free until the carinderia accepts your order. After that, cancellation is decided by Carinderya support.
• If an order is rejected, expires or cannot be delivered, you are not charged for it.
• Report wrong, missing or unsafe food through support within [24 hours]; we will work with the carinderia on a fair resolution.

5. Carinderias (merchants)

• Your store goes live only after Carinderya reviews your details and documents. You must keep your permits valid.
• Subscription: ₱499 per month per store; the first month is free. Invoices are due within 7 days; a store with an invoice overdue for more than 7 days is paused until it is paid. [Fees may change with 30 days’ notice — confirm.]
• Carinderya takes no commission on your food sales. You keep your menu prices, the delivery fee when you deliver yourself, and you fund only the store vouchers you choose to create.
• Weekly statements (Monday to Sunday) settle the cash: you pass on the ₱10 service fees from cash orders you collected, and Carinderya pays you for food on orders its riders collected.
• Keep your menu, prices, opening hours and “sold out” switches accurate, and respond to new orders promptly.

6. Riders

• Riders join by invitation, after Carinderya verifies their details and vehicle.
• Riders keep 100% of the delivery fee. Earnings are paid out weekly.
• Cash collected from customers belongs to the carinderia and Carinderya, apart from your delivery fees, and must be handed over as instructed.
• While you are delivering, the app shares your location with the customer, from pickup until the delivery ends.
• Follow traffic laws and handle food safely. [Rider engagement terms (independent contractor status, insurance) to be confirmed with counsel.]

7. Ratings and conduct

• Ratings must be honest and about your own order. No abusive, false or personal content.
• Do not misuse the apps: no fake orders, fraud, harassment, scraping or attempts to break security.

8. Liability

We work to keep the service available and accurate, but it is provided “as is”. To the extent the law allows, Carinderya is not liable for indirect losses, and our total liability for a claim is limited to [the amount you paid for the order concerned]. Nothing in these terms limits rights you have under the Consumer Act of the Philippines (Republic Act No. 7394) or other laws that cannot be waived.

9. Changes and ending

We may update these terms; we will tell you in the apps before important changes take effect. You can stop using Carinderya and delete your account at any time.

10. Law and contact
